Leyes ambientales en Río de Janeiro: una mirada histórica desde el Brasil colonial hasta la neoliberalización de la naturaleza

Abstract

Este artículo aborda las leyes ambientales del contexto territorial del estado de Rio de Janeiro, en Brasil. Se hace una revisión de la historia de la conformación del campo político y jurídico ambiental de este estado brasileño. Desde una perspectiva histórica, se presentan las diferentes fases del tratamiento institucional de la naturaleza. La intención es señalar que, a pesar de que el “tema ambiental” aún no había sido nombrado como tal, los antecedentes de las leyes y políticas ambientales en el contexto actual son más antiguos que ciertos hitos de la segunda mitad del siglo XX, definidos desde una perspectiva hegemónica. Por un lado, es cierto que parte de las estructuras actuales se conformaron hace pocas décadas. Por otro lado, la política ambiental se remonta a procesos anteriores, como una actividad que tiene que ver con la conformación del Estado mismo y su maquinaria. Más allá de la idea de que el Estado se encarga de la naturaleza bajo el canon jurídico de la posguerra y los derechos fundamentales solo en la segunda mitad del siglo XX, se postula que el tratamiento institucional de la naturaleza tiene raíces profundas que llegan hasta el pasado colonial de Brasil.

<strong>Environmental laws in Rio de Janeiro/Brazil: a historical look from colonial Brazil to the neoliberalization of nature</strong> <br> This article examines with environmental laws in the territorial context of the state of Rio de Janeiro, Brazil. A review is made of the history of the conformation of the environmental political and legal field of this Brazilian state. From a historical perspective, the different phases of the institutional treatment of nature are presented. The intention is to point out that, although the "environmental issue" had not yet been named as such, the antecedents of environmental laws and policies in the current context are older than certain milestones of the second half of the 20th century, defined from a hegemonic perspective. On the one hand, it is true that part of the current structures were formed a few decades ago. On the other hand, environmental policy goes back to earlier processes, as an activity that has to do with the conformation of the State itself and its machinery. Beyond the idea that the State is in charge of nature under the post-war legal canon and fundamental rights only in the second half of the twentieth century, it is postulated that the institutional treatment of nature has deep roots that go back to Brazil's colonial past.
